I was disallowed the eic tax credit for 06. Will i still receive a refund for 07?

I was disallowed the eic credit for the 2006 six tax year which resulted in penelties and fees. I was disallowed because i had a difficult time gathering documentation the irs requested from me to prove that im elgible for this credit. I was told to fill out an 8862 for and attach it when i file my taxes for 2007. I want to know if i will still recieve a refund for 2007? Also what kind of documents are is the irs willing to accept in order to pass the relationship test and residency test because i can not substantial evidence of neither. Any helpful advice is much appreciated.

There is a %26quot;three prong%26quot; test to claiming EIC; Relationship, Age and Residency. If you have no legal papers granting you custody or guardianship, you are not going to be able to claim EIC. Did you actually receive a refund with EIC last year? You might have to pay that back.



Basically, you don%26#039;t have court ordered custody, you cannot claim these children for EIC because they are not YOUR qualifying children.

You might or might not get it. If it was disallowed last year, and nothing has changed, probably not.



What relationship IS the child to you? And how old is the child? It%26#039;s very hard to answer your questions as to what type of doc the IRS will accept without that info. Please post again with more info and maybe you can get a better answer. But didn%26#039;t the IRS tell you what they wanted when you were working with them for last year%26#039;s return?
